1. Acceptance of Terms

Welcome to Hazara Pay ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of the Hazara Pay website located at www.hazarapay.com, our mobile applications (if any), and all related services, features, content, and applications (collectively, the "Service"). The Service allows you to purchase and send mobile phone topup credit ("Topup") to prepaid mobile numbers in Afghanistan.

By accessing, registering for, or using the Service, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and our Privacy Notice. If you do not agree to these Terms, you must not access or use the Service.

2. Service Description and Eligibility

Hazara Pay acts as an intermediary platform that facilitates the purchase of mobile airtime and data bundles from various Afghan telecommunications operators ("Operators"), including but not limited to AWCC, ATOMA, Roshan, Salaam, and Etisalat.

Eligibility:

To use the Service, you must:

  • Be at least 18 years old or the age of majority in your jurisdiction.
  • Have the legal capacity to enter into a binding contract.
  • Use the Service only for personal, non-commercial purposes unless expressly authorized.
  • Provide accurate, current, and complete information during registration and maintain its accuracy.

We reserve the right to refuse service, suspend, or terminate accounts at our sole discretion.

3. User Account and Security

To complete a transaction, you may need to register an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activities that occur under your account.
  • Notifying us immediately of any unauthorized access or security breach.

We are not liable for any loss or damage arising from your failure to protect your account information.

4. Topup Transactions: Process, Fees, and Limitations

a. Process:

To send a Topup, you must:

  1. Provide the correct, full Afghan mobile number (including country code +93).
  2. Select the Operator and the amount/bundle.
  3. Provide valid payment through our approved payment gateways.
  4. Confirm the transaction. You will receive an on-screen and email confirmation upon successful completion.

b. Pricing and Fees:

All prices for Topups are displayed on the Service in your selected currency. Prices are dynamic and may include our service fee, which is integrated into the displayed topup amount. All applicable taxes and foreign exchange rates are included or will be clearly indicated before you confirm the payment. We reserve the right to adjust prices at any time, but changes will not affect transactions already completed.

c. Transaction Limitations:

For security and regulatory compliance, we impose limits on transaction frequency and value. These limits may vary by user, country, and payment method, and are subject to change without prior notice.

d. Finality and Irreversibility:

Once a Topup transaction is successfully submitted and confirmed by the recipient's Operator, it is final and non-refundable. We cannot cancel, modify, or refund a completed Topup, except as required by law or at our sole discretion in cases of proven system error on our part.

5. User Responsibilities and Acceptable Use

You agree to use the Service lawfully and ethically. You expressly agree NOT to:

  • Use the Service for any illegal purpose, including fraud, money laundering, or financing illegal activities.
  • Send Topups to numbers obtained without the owner's consent.
  • Use the Service to harass, threaten, or harm others.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Attempt to gain unauthorized access to any part of the Service or its related systems.
  • Provide false, inaccurate, or misleading information.
  • Reverse engineer, decompile, or disassemble any aspect of the Service.

6. Payment Terms

You authorize us (or our third-party payment processors) to charge your chosen payment method (credit/debit card, PayPal, etc.) for the total amount of your purchase, including all fees. By providing payment information, you represent that you are authorized to use the designated payment method. Failed payments may result in transaction cancellation and potential account suspension.

7. Intellectual Property

All content, features, functionality, design, logos, and software on the Service are and will remain the exclusive property of Hazara Pay and its licensors. The Service is protected by copyright, trademark, and other laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for its intended purposes only.

8. Disclaimer of Warranties and Limitation of Liability

a. "As Is" Service:

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, HAZARA PAY EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

b. No Warranty on Operator Services:

WE ARE NOT AN AFGHAN TELECOMMUNICATIONS OPERATOR. WE DO NOT GUARANTEE THE QUALITY, COVERAGE, OR AVAILABILITY OF THE OPERATORS' NETWORKS OR SERVICES. DELAYS, FAILURES, OR ERRORS IN TOPUP DELIVERY MAY OCCUR DUE TO OPERATOR NETWORK ISSUES BEYOND OUR CONTROL.

c. Limitation of Liability:

IN NO EVENT SHALL HAZARA PAY, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT OF FEES YOU PAID TO US IN THE 6 MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR $100 USD, WHICHEVER IS LESS.

9. Indemnification

You agree to defend, indemnify, and hold harmless Hazara Pay and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your breach of these Terms; (b) your use of the Service; or (c) your violation of any law or the rights of a third party.

10. Termination

We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service ceases immediately. All provisions of these Terms which by their nature should survive termination shall survive.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Federal Republic of Germany, without regard to its conflict of law provisions.

Any dispute, controversy, or claim arising out of or relating to these Terms shall be resolved amicably through good-faith negotiations. If unresolved within 60 days, it shall be finally settled under the Rules of Arbitration of the International Chamber of Commerce (ICC) by one arbitrator appointed in accordance with said Rules. The place of arbitration shall be Federal Republic of Germany.

12. Miscellaneous

  • Force Majeure: We are not liable for any failure to perform due to causes beyond our reasonable control.
  • Entire Agreement: These Terms, with our Privacy Notice, constitute the entire agreement between you and Hazara Pay.
  • Severability: If any provision is found invalid or unenforceable, the remaining provisions will remain in full effect.
  • Changes to Terms: We reserve the right to modify these Terms at any time. We will notify users of material changes via email or a prominent notice on the Service. Your continued use after changes constitutes acceptance.
